These Terms of Use ("Terms") apply to the Cypher Builds website at cypherbuilds.com and to the apps published by Cypher Builds LLC ("Cypher Builds," "we," "us"). By using our website or apps, you agree to these Terms.

The apps and the App Store EULA

Our iPhone apps are licensed, not sold, to you. Unless we provide a separate custom license for a specific app, your use of our apps is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. Those terms apply in addition to these.

Acceptable use

Please use our website and apps lawfully and as intended. Don't attempt to disrupt, reverse-engineer beyond what the law allows, misuse, or interfere with the website, the apps, or other people's use of them.

Intellectual property

The Cypher Builds name, the website, the apps, and their content are owned by Cypher Builds LLC and are protected by applicable intellectual-property laws. We grant you a personal, non-exclusive, non-transferable right to use the apps under these Terms and any applicable EULA. All rights not expressly granted are reserved.

Provided "as is"

Our website and apps are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website or apps will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Cypher Builds LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the website or apps. Where liability cannot be excluded, it is limited to the amount you paid us (if any) for the relevant product.

Changes

We may update these Terms from time to time. When we do, we'll update the effective date above and post the revised Terms on this page. Continued use after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Idaho, United States, without regard to its conflict-of-laws rules. For app-specific matters, Apple's Standard EULA may specify additional terms.
